Producers Must Meet RulesPublished Wednesday, October 23, 1996 in the Gurdon TimesThe Clark County Farm Service Agency must annually notify producers of payment limitation and payment eligibility requirements. In order to participate and request benefits in the following USDA programs, producers must meet person and/or actively engaged in farming rules: Production Flexibility Payment, Loans, Marketing Loan Gains (expect honey), Loan Deficiency Payments, Conservation Reserve Program, Agricultural conservation Program and Emergency Conservation Program. Each program limits the amount of benefits a person can receive. No program benefits subject to limitation may be provided until all required forms for the specific situation are provided and the necessary payment limitation and payment eligibility determinations are made. Payment limitation and payment eligibility determinations may be initiated by the County Committee or by the producer. Statutory provisions require entities earning program benefits that are subject to a limitation to provide the names, addresses, and identification numbers of the entities' members to the County Committee. All Farm Operating Plans and all Permitted Entitiy designations are subject to spot check through end-of-year review process. If selected, you will be required to submit documentation to show that the farm plan was carried out as certified. Spouses may be considered separated persons for payment limitation purposes if this determination is reequested and the applicable requirements are met. A determination of not "actively engaged in farming" results in the producer being ineligible for any payment or benefit requiring a determination of "actively engaged in farming". If the farming operation has not made changes to the structure of the entity or the farm plan since the previous determination was made, the previous determination will still be in effect. Producers are responsible for notifying the County Office of Any change in the farming operation. Any unrevealed circumstances could result in a moree restrictive rule.
