Property Is To Be Condemned

Harold Hurst, manager of the Gurdon Water and Sewer Department, was given the authority to sign condemnation papers for the Gurdon Rural Water Project.

In a special called meeting of the Gurdon Water and Sewer Commission, held Thursday, April 3, the panel gave Hurst this approval.

A total of 27 sections of property had to be condemned for the project.

In the March meeting of the commission, it was discussed who should sign the condemnation papers. Hurst said city attorney Eric Hughes had been working on the issue, and said the chairman and manager of the department were responsible.

Hughes told Hurst the law gave this authority to the governing body. This meant Hurst and commission president Bill Dulin would have to sign the papers.

However, Dulin had to be reappointed to the position, as his term was scheduled to expire on March 31. Dulin told the panel while he would gladly accept being reappointed, he would resign if he had to sign the condemnation papers.

Dulin said it had been Charles Summerford's, project engineer, position the county judge had to sign, as he signed off on the grants.

Hurst said Gurdon Mayor Rick Smith had signed everything else, and it may be his responsibility to sign the condemnation papers.

Dulin, though, absolutely refused to sign the papers, saying he didn't want to get the city in any trouble and had no right to sign.

In the end, his objections had no relevance as Hurst was given the authority to put his signature on the condemnation papers.

The only other measure of business at the special meeting was a recommendation for a vacancy on the panel.

Dulin and Danny Paul will be recommended for spots on the board when the city council meets in regular session Monday, April 14.
