A 39-year-old Rosston man was charged with a third offense of driving while intoxicated recently.

According to Hebb Sorrells, public information officer with the Nevada County Sheriff's Office, Deputy Danny Martin was traveling north on Highway 371when he noticed a vehicle slowing down, speeding up and weaving across the center and fog lines.

Martin stopped the car and noticed the strong odor of alcohol coming from the vehicle when he approached.

When he asked the driver to step out, Tidwell had problems standing up. He was arrested, taken to the Nevada County jail and given a breath test. Tidwell registered 0.25 on the test, or two-and-a-half times the limit for DWI.

A background check revealed two previous DWI arrests. Should Tidwell be arrested a fourth time for this offense, it will be a felony, carrying a sentence of at least a year in prison.
