Former Emmet Council Member Sees Case Moved

A former member of the Emmet City Council will be going to trial for terroristic threatening and a second offense of domestic battery.

Bobby McBride has a court date of Thursday, Sept. 17, 1998, for these two felony charges.

According to Municipal Court records, McBride was sentenced to a year in jail, with all but five days suspended, on a battery charge. He was also fined $525, will have to pay restitution if the victim so desires and have no further contact with the victim. He served his five days from July 1-5.

Circuit Court records show the domestic battery and terroristic threatening charges to have occurred Saturday, June 13.

McBride, 55, reportedly went to the home of his ex-wife, Edythe, to pick up weapons belonging to him at around 10:30 p.m. on the evening in question. When he arrived, he allegedly started arguing with his ex-wife, pushed and hit her.

When she attempted to call the Nevada County Sheriff's Office, he reportedly ripped the phone out of the wall.

McBride reportedly took some of his guns to his truck and returned for the rest, only to find the door had been locked. He then attempted, records state, to kick the door in but was unsuccessful.

Court records state he then left the scene, but returned later that night to get the rest of his guns.

According to the records, Tiffany McBride told him he could have the rest of his guns when he got the remainder of his personal belongings out of the house.

He allegedly tried to push his way into the house, but was unable to.

Tammy Smith, records show, said McBride slapped and pushed his ex-wife around, threatening to return the next day, get his guns and blow the house and everything in it up.

Terroristic threatening and the second offense of domestic battery in the third degree are class D felonies. A class D felony carries a prison sentence up to six years in the state penitentiary and a fine of no more than $10,000.
