Gurdon man jailed on felony battery chargeBy Jeremy LangleyPublished Wednesday, October 31, 2007 in the Gurdon Times A Gurdon man has been charged with felony domestic battery and resisting arrest following an incident that occurred at his residence on Sept. 15. According to records on file with the Clark County Circuit Clerks office, Laviaikio Levingston, 38, of 1587 Smithton Rd., was arrested after sheriffs deputies responded to his home after a report of a domestic dispute. The report states that the altercation began as a verbal argument between Levingston and the victim but soon became physical. The victim told police that Levingston pushed her into the wall inside the house leaving two body sized holes in a sheetrock wall, according to the affidavit on file. Investigators say Levingston confessed to pushing the victim into the walls. A Clark County domestic abuse coordinator confirmed the two holes after a visit to the residence, according to the report. Once deputies were on scene, the report indicates that Levingston resisted physically and took an aggressive stance towards deputies. Court records indicate that Levingston plead guilty to domestic battery in 2006. That guilty plea makes this offense a felony. A $10,000 bond was set, and Levingston has filed an affidavit of indigency. The affidavit allows him to be represented by a public defender. A no contact order has also been placed between Levingston and the victim, the records indicate. A trial date was set in the case, but Levingstons attorney filed a motion to continue the case to a later date. Circuit Judge John Thomas granted the request on Oct. 1.
