Dispute results in assault chargeBy Wendy LedbetterPublished Wednesday, October 10, 2007 in the Nevada County Picayune Charges have been filed related to a December argument. Arlton Nichols, 75, 807 Nevada 7, Buckner, has been charged with aggravated assault and terroristic threatening after allegedly pointing a gun at three men on his property. According to records on file at the Nevada County Circuit Clerks Office, a man was on Nevada County Road 49 on Dec. 1 looking for his hunting dog. According to the records, the man was near the Nichols property when Nichols arrived in a pickup. Hernandez alleged that Nichols retrieved a rifle from his vehicle, pointed it at him and thold him that he was going to shoot him if he did not leave. Two additional witnesses arrived at the scene at that point, according to the record. Both men apparently backed Hernandezs story, saying that Nichols also pointed the rifle at each of them and advised that he would shoot them as well if htey didnt leave his property. Nichols then reportedly left. The records indicate that Nichols told authorities that he did present his firearm to the first man, but that it was because the man advanced toward him after he had asked him to leave. Nichols reportedly told authorities that both the witnesses also advanced toward him, prompting his action. The case was filed at the end of September.
