Venue change soughg in Cummins case

Citing massive media coverage in the murder of James H. Booger Cummins, the attorney for Robert Lee Williams, Jr., is asking for a change of venue.

The motion requesting the change was filed Thursday, July 28, with the Nevada County Circuit Court.

Cathleen Compton, Williamss lawyer, states another the reason for change as being the popularity of the victim. Because of this, the motion states, the defendant cant get a fair trial in Nevada County, and requests it be moved to Hempstead County, as it is the most convenient county in the district other than Nevada County.

According to the motion no prejudice will result to the state if the motion is granted.

At this time, however, the case is before the Arkansas Supreme Court on an interlocutory appeal. Because of this no trial date can be scheduled at this time.

The motion was accompanied by three affidavits swearing Williams would be unable to get a fair trial in the county.

Circuit Judge Duncan Culpepper will make a ruling on this motion.
