McSwain charged with burglary afer breaking into houses

Kory McSwain, 18, has been charged with a class B felony, residential burglary, and a class C felony, theft of property.

According to court records, on June 29, Jose Tamez reported to Prescott Police his home had been entered and several items had been removed.

He said he was missing a gold chain, two gold bracelets, two gold rings, a watch, $720 in United States currency, $200 in Mexican pesos, and a Go-Cart.

On July 3, Tamez told the Prescott Police his home had been entered again.

This time with several tools and a Boss Car Stereo Amplifier missing.

Information during the investigation by PPD Det. Morris Irwin, led to the conclusion the McSwain may have been involved.

On July 7, Officer Scott Sundberg and Det. Irwin went to McSwain's home and read him his Miranda rights.

McSwain then reportedly confessed he had entered Tamez's home on two occasions.

On the first occasion, he reportedly said he went to the residence of Tamez with another individual. McSwain said they entered the home through a window, but stated he did not take anything from the inside of the residence.

He said, however, he did take the Go-Cart from the lawn. McSwain said he returned to the residence again, this time with his younger brother, and entered the home through the same window.

He then reportedly admitted to stealing several tools and the car amplifier.

McSwain led the officers to a duffle bag filled with the tools hidden in his backyard. He escorted the officers to a vacant residence where the Go-cart had been parked.

McSwain was taken to the Nevada County Detention Facility, and was charged with the above felonies.

A class B felony is punishable by imprisonment for no less than five years and no more than 20 and/or a fine not to exceed $15,000.

A Class C felony is punishable by imprisonment for no less than three years and no more than 10 and/or a fine not to exceed $10,000.
