Traffic stop results in arrest for drugs

A routine traffic stop revealed $200 worth of marijuana hidden in vehicle.

James Cummings, 25, of Hensley, was subsequently charged for a class "C" felony.

Prescott Police officer Ann Jordan was monitoring traffic on West First Street or Highway 67 when she stopped a car going 50 mph in a 35 mph zone.

When addressing the driver of the car, Cummings, Jordan noticed he became nervous and began to shake while speaking to her.

Due to his condition Jordan requested permission to search the car. Two other subjects, James McGee and Michael Leonard, both of Gurdon, were also present in the car.

PPD officer Danny Miller arrived and watched over the three subjects while Jordan searched the car.

According to court records, Miller asked Cummings if there was anything in the car, and Cummings replied, "If it is, I don't know anything about it."

The searched revealed a large plastic bag containing two smaller bags of a green leafy substance believed to be marijuana under the passenger side seat.

When asked about the ownership of the controlled substance all three denied it. All three subjects were then arrested and transported to the Nevada County Sheriff's Office where Leonard and McGee said the substance belonged to Cummings.

When asked about the substance Cummings admitted it belonged to him and he had bought it for $200.

Cummings was taken back into custody and McGee and Leonard were both released.

A class "C" felony is punishable by imprisonment for no less than four years and no more than 10 and/or a fine for no more than $25,000 in this instance.
