Charges filed vary in recent drug raidBY AUTUMN PENNINGTONPublished Wednesday, January 30, 2002 in the Gurdon Times On January 11, Gurdon Police officers and other surrounding law enforcement agencies were able to arrest 13 Gurdon residents for several different drug charges. These charges ranged anywhere from, delivery of a counterfeit substance, using another person's property to facilitate a certain crime, delivery of a controlled substance (marijuana), delivery of a controlled substance (crack cocaine), maintaining a drug premises in a drug free zone and delivery of a controlled substance in a drug free zone. Most people would say, "I thought everywhere was considered to be a drug free zone." This is true however, delivering or selling a controlled substance within 1,000 feet of a certified drug free zone such as a school, a church or a daycare is illegal. This is a Class Y felony and you could be imprisoned for no less than 10 years and no more than 40 years or life. It also carries a fine not to exceed $25,000. Of the 13 people arrested on January 11, eight of them were charged with delivery of a controlled substance within a drug free zone and some of them had two counts against them. This is a class B felony and is punishable by a prison term of no less than five years and no more than 20 years and holds a fine of $15,000 or a fine and imprisonment. Those arrested for delivery of a controlled substance (marijuana) are charged with a Class C felony. A Class C felony is a prison term of no less than three years nor more than 10 years. It can also hold a fine of no more than $10,000. There were six Class C felony charges made on January 11. Delivery of a controlled substance (crack cocaine) is considered to be a Class Y felony which has already been explained in the first few paragraphs. Of the 13 Gurdon residents arrested on January 11, nine of them were arrested for delivery of crack cocaine of the possession of with the intent to deliver. Bond was set for these 13 individuals anywhere from $150,000 to $1,500. Some of them have already bonded out, but will all face trial motions on February 4, and a trial date has been set for February 25. Since the raid on January 11, Gurdon City Marshall, Don Childers, has kept busy trying to locate those not arrested that day, but holding warrants for their arrests. Childers has been successful with one other arrest of, Elander Kennel age 26 of 502 Seahorn St. for delivery of a controlled substance (crack cocaine), two counts. He is also charged with two counts of a drug delivery within a drug free zone. Plus a charge of unauthorized use of property to facilitate a crime was also placed against him. Bond for Kennel has been set at $150,000. Childers says he is not through yet and still has warrants for two more people. Childers sounded hopeful on making the arrest of these two.
