Two Arrested In Separate Drug Cases By Co. DeputyBY JOHN MILLERPublished Wednesday, May 3, 2000 in the Nevada County Picayune Melchizedek Shabazz, of Prescott has been arrested and charged with possession of a controlled substance with intent to deliver. According to reports from the Nevada County Sheriff's Office, deputy Danny Martin stopped Shabazz around 7:40 p.m. Saturday, April 29, for not having his headlights on while operating the windshield wipers on his vehicles. This is a violation of state statute 37-26-204. Under this law, any time a vehicle's windshield wipers are in use, the headlights must be turned on. Shabazz gave consent to search his vehicle, and Martin found an off-white substance believed to be crack cocaine. He then placed Shabazz under arrest. The fun wasn't over, though. After Martin had booked Shabazz for possession, he checked the back seat of his patrol car and found 18 individually wrapped pieces of an off-white substance believed to be crack cocaine in the vehicle. Prior to Shabazz being arrested, no one had been in the back seat of Martin's patrol car. Shabazz was then charged with possession of a controlled substance with intent to deliver. This is a class Y felony carrying a sentence of 10 to 40 years in prison or life. DRUG ARREST Martin arrested Clarence Gulley Jr., Friday, April 21, for simple possession of marijuana. Martin was patrolling along Highway 371 south of Rosston when a vehicle approached and wouldn't dim its headlights. The officer turned around and stopped the other vehicle. He noticed it had expired tags and the driver, Gulley, had no proof of insurance. Gulley was placed under arrest, and during the search, a plastic bag filled with a green, leafy substance believed to be marijuana was found in his left front pocket. A .22-caliber handgun was found in Gulley's possession as well. He was cited and released. However, it was later learned Gulley had a previous charge for possession of a controlled substance in Stamps. By law, two charges of misdemeanor possession of marijuana constitute a felony offense.
